These terms and conditions apply to the contents of the website under the domain name www.flowershopbasingstoke.co.uk (the Website) whether you act as a private individual and consumer or as a business (referred to as "You" other than where specifically indicated) and a Company.

 By accessing the Website, You have accepted these Terms in full. If You do not accept these Terms in full, You must leave the Website immediately.

1. PRODUCTS
1.1 All products are subject to market availability Blooms of Basingstoke (BFB), reserve the right to change all or some of the contents or packaging for all requested floral arrangements or gifts to provide an item of equal or greater value without notice. Prices of goods on the website are subject to change without notice.

1.2 Flowers will more often be delivered in bud to ensure longer life.

1.3 Flowers and Plants may be harmful or poisonous, if you are unsure please contact us. Please do not eat any flowers and plants delivered.

1.4 If Blooms  are unable to supply the product selected or a suitable  substitute product to you, we shall contact you as soon as possible and will reimburse your payment in full within 5-10 days of the intended delivery date.

PRODUCT LIABILITY

1.5  We will not be liable for any loss you suffer through failure to use the Product ordered  in a normal and proper manner or through altering or modifying the Products, failure to follow any guidelines or using the Products in a careless or negligent manner.

1.6 Our liability to you for death or personal injury caused by our negligence is not limited.

1.7 Our liability to you other than for death or personal injury caused by our negligence is limited to the cost of replacement of the Products or refund of the price paid for the Products.

We will not be responsible for.  Any other loss you suffer through our failure to comply with the terms of this contract. In particular we will not have any liability for any loss that was not a reasonably foreseeable consequence of our failure to comply with the contract such as any loss of profit, opportunity or liability to any third party, or any failure to deliver Products or delay due to any event or circumstance beyond our reasonable control.

2. PRICES.

2.1 The full price for the product is shown on our website. Additional Local Delivery charges are added at checkout.

2.2 If you order flowers and gifts for the same delivery address, for the same delivery date only one charge will apply.

2.3 All our prices are quoted in pounds sterling.

3. ORDERS.

3.1  To effect successful  delivery on the date required for Floral Arrangements, Wine, Champagne, Chocolates or Gifts - BFB require complete  and accurate details of the recipient, including a full name, address details including postcode and contact telephone number.

3.2  Your order will only be processed if full payment details are given and payment cleared by the Merchant Service Provider we use. We accept payment from all major credit and debit cards and Paypal transactions, your payment is processed as soon as we receive your order,  order cancellations  -  within our cancellation terms will incur a minimum  charge of 3% to cover charges imposed by the Merchant Services Companies and our administration we use to process your payment.  Orders over £100 will be charged at 5% of value. In additional any specific requirements will be charged for.

3.4  Prices shown are valid for a maximum of 14 days of submitting your order.

3.5   Order placed online at  www.flowershopbasingstoke.co.uk will be confirmed with an automatically generated  email confirming your order details. This email will be sent to the email address you have supplied at online registration / order placement. It will include an order reference number for future correspondence. Verbal orders by telephone will not receive an email confirmation unless specifically requested.

3.6  Order for alcohol products can not be accepted from customers or be delivered to any recipient under the age of 18 years.

3.6a Orders for or including Wine or Champagne can only be delivered locally.
Under the Licensing Act of 1964 (UK) and 1976 (Scotland) it is an offence for any person under 18 years to buy, or attempt to buy, alcoholic liquor. 
Incorrect details provided lead to problems and delays, when placing an order ensure that you have included the full correct address and postcode or the intended recipient, your daytime telephone number or mobile number and email address.  We aim to complete the requested product and delivery correctly as ordered. We are at liberty to reimburse or compensate for a failure. This decision would be taken by  Blooms Florist  Basingstoke only.

3.8  BY CLICKING THE PROCEED BUTTON ON THE ONLINE ORDER FORM,   VERBALLY ORDERING OVER THE PHONE AND VERIFYING YOUR DESCRIBED ORDER WITH THE SECURITY NUMBERS ON THE BACK OF THE PAYMENT CARD YOU USE  FOR PAYMENT - 
YOU ARE CONSENTING TO BE BOUND BY OUR TERMS AND CONDITIONS.

3.9 We accept payment by credit and debit card and PAYPAL. BOB will not dispatch a Product until we have received payment from you. If for any reason payment is refused after we have dispatched the Products we will have the right to request the payment from you or recover the Products from you and charge you for our full legal  costs in recovering the Products or seeking further payment.

4. DELIVERY AND CHARGES.
Local delivery areas  are Basingstoke and Surrounding areas within a 7mile radius

4.1 Product prices exclude our delivery charges.


4.2  Deliveries are not made on Sundays or Bank Holidays (Mother's Day is the only exception and is subject to specific delivery charges). International Orders can not be processed by this website, please telephone for details.

4.3  We do not offer delivery times, the AM or PM preference is just that - a preference only. If the order is for a funeral, then the item is delivered to the Funeral Director 1-2 hours before the time given.( It is generally  considered unacceptable to send funeral pieces to the home address).  We will always try to adhere to preferences wherever possible.

4.4 Delivery dates, times and delivery call-off times are detailed on the Website www.flowershopbasingstoke.co.uk at checkout when you order Products.

4.5 For perishable hand-made florist delivered products whilst we agree to use all reasonable endeavours to ensure that delivery will be on the requested delivery date or during the delivery period.  In very occasional circumstances delivery on the requested terms will not be possible. In such circumstances you will be given prior notice wherever possible and we shall either make alternative arrangements. 

4.6 We will deliver the Products ordered by you to the address you give to us for delivery at the time you make your order. We cannot guarantee when any item will be despatched and we are unable to specify a time for delivery.

4.7 Some orders will require a signature on delivery. This will apply in the case of delivery of certain Products or to certain locations where a third party is involved, such as offices, hospitals, Funeral Directors, airports, hotels, flats or apartments with concierge services, ships and other business locations. The signature of any person authorised to accept delivery on behalf of the organisation shall be accepted as proof of delivery to your chosen recipient.

4.8 You will become the owner of the Products you have ordered when they have been delivered to you or the representative of the recipient. You are responsible for any insurance (where relevant) security after delivery. Once Products have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

4.9 Neither we, nor any courier or postal service that we use shall be liable for any failure to perform, where such failure or delay results from any circumstances outside our reasonable control including but not limited to any fire, flood, explosion, accident, adverse weather conditions, traffic congestion, mechanical breakdown, obstruction of any private or public highway, riot, government act, act of war, terrorism, act of God, or from any industrial dispute or strike whatsoever.

4.10 Please ensure that you enter full and accurate details, including the address and the postal code, of the recipient. We will not be responsible for any orders which are not delivered due to incorrect or incomplete information being supplied by you.

4.11 During peak periods delivery dates may be moved forwards to ensure safe delivery is made before or on the intended day of delivery. We will attempt to notify you of these changes prior to the delivery being completed.


5.CANCELLATION POLICY.

5.1 The customer has the right to cancel an order without reason for Wine, Champagne and other NON-PERISHABLE goods NO later than 24 hours before the required delivery date, payments made by card will incur a handling charge of 3% for our admin and to cover processing charges levied by Merchant Service Companies used  to process your payment.

5.2 The customer has the right to cancel an order  without reason for Bouquets and Floral Arrangements NO later than 24 hours before the required delivery date, payments made by card will incur a handling charge of 3% for our admin and to cover processing charges levied by Merchant Service Companies used to process your payment.


To cancel or amend your order please contact us directly on UK 01256 689699. Our offices are open from 9.00am until 5pm Monday to Friday  Closed on Saturdays, Sundays and Bank Holidays.

6 USE OF MATERIAL APPEARING ON THE WEBSITE AND INTELLECTUAL PROPERTY POLICY
